The short version: Enjoy the site, share it and use it in the classroom, and use our press kit to write about the game. Don’t copy or resell it or pass it off as your own. Life Legacies is a game in development and a way to learn history, not genealogical proof or professional advice. The game will have its own terms when it’s released.
1. Agreement to these terms
These Terms of Service (“Terms”) are an agreement between you and SeriousPixel, LLC, doing business as SeriousPlay Games (“we”, “us” or “our”). They cover your use of the website at www.lifelegaciesgame.com (the “Site”). By using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site.
2. The Game
Life Legacies (the “Game”) is in development. Features, titles, platforms and dates shown on the Site may change, and nothing on the Site is an offer to sell. When the Game is released, it will come with its own license terms, and purchases will be made through stores such as Apple’s App Store, Google Play, Steam, the Microsoft Store and itch.io, whose terms govern payment and refunds. We’ll update these Terms before the Game is released.
3. Who can use the Site
The Site is intended for visitors of all ages. If you’re under 18, or under the age of majority where you live, please review these Terms with a parent, guardian or teacher. The Site has no accounts and doesn’t ask for personal information; see our Privacy Policy.
4. Your license to use the Site
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to view and use the Site for your own non-commercial use.
Teachers and schools: you may show the Site, including its interactive timeline, maps and globe, to students in classrooms, homeschooling and other non-profit educational settings at no charge.
Press and creators: you may use the logos, images, descriptions and taglines in our press kit to write about or cover Life Legacies, as long as you don’t alter the logos or suggest that we endorse you.
5. What you may not do
Unless we give you written permission, you agree not to:
- copy, host, mirror, redistribute, sell, rent or sublicense the Site or any part of it, except as Section 4 allows;
- modify the Site or create derivative works from its code, artwork, music or text, except as the law expressly allows;
- remove or change any copyright, trademark, license or attribution notices, including the credits for the third-party data and libraries the Site uses;
- interfere with the Site, overload it, or try to get around any security or access controls;
- use automated tools to scrape or harvest the Site’s content; or
- use the Site in any way that breaks the law or infringes anyone else’s rights.
Sharing links to the Site, and screenshots of it in reviews, articles and lessons, is welcome.
6. Ownership and third-party material
The Site and the Game, including their software, simulation, artwork, sound, music, text and design, are owned by SeriousPixel, LLC and protected by copyright, trademark and other laws. “Life Legacies”, “SeriousPlay”, “SeriousPlay Games” and the related logos are our trademarks. Except for the license in Section 4, these Terms don’t give you any rights in the Site, the Game or our trademarks.
Some material on the Site comes from others under its own license, as credited on the Site: for example, map data from Natural Earth (public domain), astronomy calculations from Astronomy Engine (MIT License), and star data from the HYG database (CC BY-SA 4.0). That material is governed by its own license, which these Terms don’t change.
7. History, not proof
Life Legacies teaches history through a simulation. The Site and the Game rely on historical records and scholarship, show their sources where they can, and mark evidence as documented, reconstructed or traditional, but simulated people, places and events are simplified and may not reflect every detail of the past. Families in the Game are fictional. Nothing on the Site or in the Game is genealogical proof, legal advice or professional historical research; check original records before relying on any fact for your own family history.
8. Feedback
We love hearing ideas. If you send us suggestions or feedback, you agree we can use them to improve the Site and the Game without any obligation or payment to you.
9. Changes and availability
We may update, change, suspend or discontinue the Site, or any part of it, at any time, with or without notice. We don’t guarantee the Site will always be available, uninterrupted or error-free.
10. Links to other websites
The Site links to other websites, such as www.seriousplaygames.com and the sources we credit. We aren’t responsible for the content or practices of sites we don’t control.
11. Disclaimer of warranties
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. SOME JURISDICTIONS DON’T ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SERIOUSPIXEL, LLC AND ITS OWNERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING OUT OF OR RELATED TO THE SITE, EVEN IF WE HAVE BEEN TOLD SUCH DAMAGES ARE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED FIFTY U.S. DOLLARS (US $50).
Some jurisdictions don’t allow these limitations, so they may not fully apply to you. Nothing in these Terms limits liability that can’t be limited by law.
13. Indemnity
If you use the Site in a way that breaks these Terms or the law, and that leads to a claim against us, you agree to cover the reasonable costs and losses that result, to the extent the law allows.
14. Ending your use
You can stop using the Site at any time. We may suspend or end your access to the Site if you break these Terms. Sections 6, 7 and 11 through 16 continue to apply after your use ends.
15. Governing law
These Terms are governed by the laws of the State of Tennessee, USA, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Tennessee, and you and we consent to their jurisdiction. If you live outside the United States, you may also have rights under the mandatory consumer protection laws of your country, and nothing here takes those away.
16. General
These Terms and our Privacy Policy are the entire agreement between you and us about the Site. If any part of these Terms is found unenforceable, the rest stays in effect. If we don’t enforce a provision right away, we haven’t waived it. You may not transfer these Terms. We may transfer them, for example if the Game is sold.
17. Changes to these terms
We may update these Terms from time to time. When we do, we’ll post the new version here and change the date at the top. Continuing to use the Site after an update means you accept the new Terms.
